1. Definitions

• "Company", "We", "Us", "Our" refers to FlexFlow Yoga, registered in Turkey with registration number 65883453 and headquarters at Serhan Kavşağı 7, 25307 Erzincan, Turkey.
• "Service" refers to the website, applications, content, courses, and related services provided by FlexFlow Yoga.
• "User", "You", "Your" refers to the individual or entity accessing or using the Service.
• "Content" refers to all text, images, videos, audio, and other materials available through our Service.
• "Courses" refers to the online yoga and wellness courses offered through our Service.
• "Account" refers to the registered user account required to access certain features of our Service.

2. Acceptance of Terms

By accessing or using our Service, you confirm that:

• You have read, understood, and agree to be bound by these Terms.
• You are at least 16 years of age, or accessing the Service under the supervision of a parent or legal guardian who agrees to be bound by these Terms.
• You have the legal authority to enter into these Terms and to be bound by them.

3. User Accounts

You may terminate your account at any time by contacting us. We may also terminate or suspend your account immediately, without prior notice or liability, for any reason, including, but not limited to, if you breach these Terms.

Upon termination, your right to use the Service will immediately cease. Certain provisions of these Terms will continue to remain in effect after termination.

4. Course Enrollment and Access

4.1 Course Enrollment

Our Service allows you to enroll in and access various online yoga courses and related content. By purchasing and enrolling in a course, you gain a limited, non-exclusive, non-transferable license to access and view the course content for personal, non-commercial use.

4.2 Access Period

Unless otherwise specified at the time of purchase:

• Standard courses provide access to the course content for 12 months from the date of purchase.
• Certain premium courses or certifications may offer extended or lifetime access as specified in the course description.

We reserve the right to modify access periods for future customers, but any changes will not affect courses that have already been purchased.

4.3 Live Sessions

For courses that include live sessions:

• You are responsible for ensuring you have the necessary technical requirements to participate.
• Session recordings will typically be available within 24 hours after the live session ends and will remain accessible for the duration of your course access period.
• We reserve the right to reschedule live sessions with reasonable notice.

4.4 Course Completion

Certain courses may offer certificates of completion. To receive a certificate, you must satisfy all course requirements as specified in the course materials. Certificates are issued solely for educational purposes and may not qualify as professional certifications unless explicitly stated.

5. Payments and Refunds

5.1 Pricing

All prices for courses and services are displayed in US Dollars (USD) unless otherwise specified. Prices are subject to change, but changes will not affect courses that have already been purchased.

You agree to pay all fees and applicable taxes associated with your use of the Service. All payments are processed through secure third-party payment processors.

5.2 Payment Methods

We accept payment via major credit cards, PayPal, and other payment methods as indicated during the checkout process. By providing your payment information, you represent and warrant that you are authorized to use the designated payment method.

5.3 Refund Policy

Our refund policy is outlined in our separate Refund Policy. By purchasing our courses, you agree to the terms of our Refund Policy.

6. Intellectual Property Rights

6.1 Our Intellectual Property

The Service and its original content (excluding content provided by users), features, and functionality are and will remain the exclusive property of FlexFlow Yoga and its licensors. The Service is protected by copyright, trademark, and other intellectual property laws.

Our Content includes, but is not limited to:

• Course videos, audio recordings, and written materials
• Website design, graphics, and user interface
• Software code and functionality
• Logos, trademarks, and brand elements
• Images and photographs

6.2 License to Use Content

When you purchase a course, you are granted a limited, non-exclusive, non-transferable license to access and view the course content for your personal, non-commercial use only. You may not:

• Copy, reproduce, distribute, publicly display or perform, or create derivative works based on our Content
• Use any Content for commercial purposes without our express written consent
• Remove any copyright, trademark, or other proprietary notices from any Content
• Transfer your access to our courses or Content to another person
• Share your account credentials with others

6.3 User-Generated Content

You may have the opportunity to submit comments, feedback, or other content ("User Content") to our Service. By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, translate, distribute, and display such content in connection with providing and promoting the Service.

You represent and warrant that:

• You own or have the necessary rights to share the User Content.
• The User Content does not infringe upon the intellectual property rights or other rights of any third party.
• The User Content complies with these Terms and all applicable laws and regulations.

We reserve the right to remove any User Content at our discretion, without notice.

7. Prohibited Uses

You agree not to use the Service:

• To upload, transmit, or distribute any viruses, worms, or other material designed to interrupt, destroy, or limit the functionality of any computer software or hardware or telecommunications equipment.
• To use any robot, spider, or other automatic device, process, or means to access the Service for any purpose, including monitoring or copying any of the material on the Service.
• To record, reproduce, duplicate, copy, sell, resell, or exploit any portion of the Service or courses without express written permission from us.

8. Health and Medical Disclaimer

The information provided through our Service, including all courses, content, and materials, is for educational purposes only and is not intended as medical advice, diagnosis, or treatment.

Before beginning any exercise program, including yoga, you should consult with your healthcare provider, particularly if you:

• Have any pre-existing health conditions or injuries
• Are pregnant or recently gave birth
• Have had recent surgeries
• Are taking medications that may affect your physical abilities

By using our Service, you acknowledge and agree that:

• You are participating in yoga activities at your own risk.
• You are responsible for practicing within your own physical limitations and modifying poses as needed.
• Neither FlexFlow Yoga nor its instructors are liable for any injury or health condition resulting from using our courses or content.

Always practice yoga in a safe, clear space and stop immediately if you experience pain, discomfort, dizziness, or shortness of breath.

9. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall FlexFlow Yoga, its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your access to or use of or inability to access or use the Service.
• Any conduct or content of any third party on the Service.
• Any content obtained from the Service.
• Unauthorized access, use, or alteration of your transmissions or content.
• Any physical injury or health condition resulting from your participation in activities demonstrated in our courses.

Our total liability to you for any claim arising from or relating to these Terms or our Service shall not exceed the amount paid by you to FlexFlow Yoga during the 12 months preceding the event giving rise to the liability.

Some jurisdictions do not allow the exclusion of certain warranties or the limitation or exclusion of liability for incidental or consequential damages. Accordingly, some of the above limitations may not apply to you.

10. Indemnification

You agree to defend, indemnify, and hold harmless FlexFlow Yoga, its directors, employees, partners, agents, suppliers, and affiliates from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:

• Your violation of these Terms.
• Your User Content or feedback provided to the Service.
• Your violation of any third-party right, including without limitation any intellectual property right, privacy right, or publicity right.
• Your violation of any applicable law, rule, or regulation.

11. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Turkey, without regard to its conflict of law provisions.

Any dispute arising out of or in connection with these Terms, including any question regarding their existence, validity, or termination, shall be referred to and finally resolved by arbitration under the rules of the Turkish Arbitration Association, which rules are deemed to be incorporated by reference into this clause. The seat, or legal place, of arbitration shall be Erzincan, Turkey. The language to be used in the arbitration proceedings shall be English.

12. Changes to Terms

We reserve the right to modify or replace these Terms at any time at our sole discretion. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the Service.

13. Severability and Waiver

13.1 Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent necessary, and the remaining provisions of the Terms will continue in full force and effect.

13.2 Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. The waiver of any such right or provision will be effective only if in writing and signed by an authorized representative of FlexFlow Yoga.

14. Entire Agreement

These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and FlexFlow Yoga regarding your use of the Service and supersede all prior and contemporaneous written or oral agreements between you and FlexFlow Yoga.
